Introduction

These terms and conditions regulate consumer purchases of goods over the internet. A consumer purchase refers to the sale of goods to a consumer who is not acting mainly as part of a business, and where the seller is engaged in commercial activity through the online store.

This contract is based on, and compliant with, the recommended template from the Norwegian Consumer Authority (Forbrukertilsynet).

Consumer purchases over the internet are governed primarily by the Norwegian Contract Act, the Consumer Purchases Act, the Marketing Act, the Right of Withdrawal Act, and the E-Commerce Act, all of which grant the consumer non-waivable rights. Nothing in these terms shall be interpreted as a limitation of statutory consumer rights. These terms outline the key rights and obligations for both parties, while the seller is free to offer more favourable conditions than the minimum required by law.

Where these terms do not provide a complete answer, relevant statutory provisions apply.

1. The Agreement

The agreement between the buyer and the seller consists of the information provided by the seller in the online checkout (including, but not limited to, the nature of the goods, quantity, quality, other characteristics, price, and delivery terms), any direct correspondence between the parties (e.g., email), and these Terms and Conditions.

If there is a conflict between the information in the checkout, the direct correspondence, and these Terms, the checkout information and direct correspondence take precedence, provided that this does not conflict with mandatory consumer legislation.

2. The Parties

Seller:
Company Name: POLAR BEAR TACTICAL AS
Address: Blikstadveien 48, 2450 Rena, Norway
Email: admin@polarbeartactical.com
Phone: +47 452 01 205
Organization number: 931 940 635

Buyer is the individual placing the order.

3. Prices

All prices listed in the online store include VAT unless otherwise stated.

Total costs payable by the buyer — including VAT, duties, shipping, and all additional charges — will be clearly shown before completing the purchase.

Orders shipped to Svalbard or Jan Mayen are sold without VAT, in accordance with Norwegian regulations.

4. Conclusion of Contract

The agreement is binding for both parties once the seller has received the buyer’s order.

Neither party is bound if there has been a typing or input error in the checkout or the order, and the other party realized or should have realized that such an error occurred.

5. Order Confirmation

Once the seller has received the order, an order confirmation will be sent without undue delay.

The buyer is encouraged to check that the confirmation matches the order. In case of discrepancies, the buyer should contact the seller as soon as possible.

6. Payment

The seller may charge for the goods once the goods are dispatched.

For payment by credit or debit card, the seller may reserve the purchase amount on the card for up to 4 days.

Invoices (if offered) will have a minimum 14-day due date from the time the buyer receives the goods.

The seller may require advance payment in special cases, such as custom/manufactured-to-order products.

Buyers under 18 may only pay upon delivery or by cash-on-delivery, as they cannot incur debt.

6.1 Pre-Orders

When placing a pre-order, you pay in advance.
Production and delivery begin once our minimum production requirement is met.

Your rights for pre-orders:

  • You have a 14-day right of withdrawal from the date of purchase.

  • After 14 days, the pre-order is not automatically refundable, but you may receive a refund if:

    • the production cannot be carried out

    • the estimated delivery time is significantly delayed

    • the product has defects under applicable law

If production cannot be completed, you will receive a full refund automatically.

After receiving the product, you receive a new 14-day right of withdrawal.

Estimated delivery time:
Delivery dates for pre-orders are estimates based on production and logistics.
Delays may occur, and the estimated date is not guaranteed.
We will keep customers updated throughout the process.

7. Delivery

Delivery is carried out in the manner and to the location specified at checkout.

If no delivery date is stated, delivery must occur within a reasonable time and no later than 30 days after purchase.

8. Risk of the Goods

Risk passes to the buyer when the goods are taken over by the buyer.
If the buyer fails to receive the goods at the agreed time, risk may still pass if the delay is the buyer’s responsibility.

9. Right of Withdrawal

The buyer may withdraw from the purchase in accordance with the Right of Withdrawal Act.

The buyer must notify the seller within 14 days after receiving:

  • the goods,

  • adequate information about the right of withdrawal, and

  • the withdrawal form.

The full refund must be issued within 14 days after the seller receives the returned item.

The buyer may examine the product but must return it in essentially the same condition.

Certain goods are exempt from the right of withdrawal (e.g., items that cannot be returned for hygienic or practical reasons).

10. Duty of Inspection

The buyer is encouraged to inspect the goods upon delivery and report any issues promptly.

11. Complaints and Time Limits

A complaint must be made within a reasonable time after a defect is discovered, and no later than 2 years after receiving the item (5 years for items expected to last significantly longer).

Claims regarding delays must be made shortly after the delivery date has passed.

If paid by credit card, the buyer may also contact the card issuer.

12. Buyer’s Rights in Case of Delay

The buyer may:

  • withhold payment

  • demand fulfilment

  • cancel the contract if the delay is substantial

  • claim compensation

13. Buyer’s Rights in Case of Defects

The buyer may:

  • withhold payment

  • demand repair or replacement

  • demand a price reduction

  • cancel the contract (unless the defect is minor)

  • claim compensation

The seller may attempt repair or replacement twice unless special circumstances apply.

14. Seller’s Rights in Case of Buyer’s Breach

If the buyer fails to pay or fulfil obligations, the seller may:

  • withhold the goods

  • demand payment

  • cancel the contract in case of substantial breach

  • claim compensation

  • charge interest or collection fees according to law

15. Guarantee

Any guarantee is in addition to, and does not replace, mandatory consumer rights.

16. Personal Data

Personal data will only be collected and stored as necessary to fulfil the agreement. Data on individuals under 15 may only be processed with parental consent.

Data will only be shared where necessary to complete the transaction or where required by law.

If data is used for other purposes, explicit consent is required.

The buyer may request access, correction, or deletion at any time.

17. Dispute Resolution

The parties shall seek to resolve disputes amicably.

The buyer may contact the Norwegian Consumer Council (Forbrukerrådet) for mediation.
If unresolved, the dispute may be brought before the Consumer Disputes Commission (Forbrukertvistutvalget).
Decisions can be appealed to the courts within four weeks.
